Demo terms of use

This is an English translation for convenience. The Czech version is binding.

These terms govern the use of the demo version of rhythmees, the dance club management platform (the “Platform”), at demo.rhythmees.com (the “Demo”). The Demo is free of charge, is intended for trying the Platform out and works exclusively with fictitious data.

See also Privacy policy.

1. Operator

1.1The Demo is operated, and the Platform is owned, by Tomáš Kasalický, IČO 14033917, with registered office at Mladotova 663/2, Kolovraty, 103 00 Praha 10, a natural person doing business under the Trade Licensing Act, registered in the Trade Register, not a VAT payer (the “Operator”). Contact: kasalicky@proton.me.

1.2“TK Demo” and all persons, lessons, payments, results and other data shown in the Demo are fictitious and serve only to demonstrate the Platform’s features. The exception is the list of national champions, which contains real historical results (clause 5.5).

2. Acceptance of the terms

2.1By entering the Demo, i.e. by choosing a role on the home page or by using a personal access link, the user confirms that they have read and agree to these terms, and acknowledges the Privacy policy. This creates a free-of-charge contractual relationship between the user and the Operator for the use of the Demo.

2.2A user who does not agree to the terms is not entitled to use the Demo.

3. Nature of the Demo

3.1The Demo is a free sample of the Platform intended to introduce its features. It is not an offer to conclude a contract for the provision of the Platform; such a contract is concluded separately and on terms agreed with the Operator.

3.2The content of the Demo is reset to its default state regularly, usually every night. All changes and data entered by users are irreversibly deleted in the process.

3.3The Demo does not send e-mails, and the payment details shown in it (including QR payments) are deliberately invalid. The range of features in the Demo may differ from the Platform provided to clubs.

3.4The Operator may change, restrict, suspend or discontinue the Demo at any time and without prior notice, or restrict access for a particular user.

4. Rules of use

4.1The Demo is shared; content a user enters may be seen by other users until the next reset. Users do not enter real personal data into the Demo, in particular data of other persons and data of children, nor confidential information.

4.2Users must not upload to the Demo content that is unlawful or offensive, infringes the rights of third parties or contains malicious code.

4.3Users must not circumvent or interfere with the security of the Demo, overload it, access it by automated means (bots, scrapers), examine its source code beyond the extent expressly permitted by law, or use the Demo for any purpose other than trying it out.

4.4The Operator may remove content that breaches these terms at any time.

5. Intellectual property and licence

5.1The Platform, including the software, source and object code, database structure, graphic design, user interface, texts, logos and other elements, is protected in particular by Act No. 121/2000 Coll., the Copyright Act. All economic rights to it are exercised exclusively by the Operator; all rights reserved.

5.2The Operator grants the user a free-of-charge, non-exclusive, non-transferable authorisation, revocable at any time, to use the Demo through a web browser solely for the purpose of trying it out, for as long as it is available. Any other use, in particular copying, modification, reverse engineering, distribution, rental, provision to third parties or the creation of derivative works, is not permitted unless expressly allowed by law.

5.3The Operator has the exclusive right to further license the Platform, grant sublicences to it and provide it to third parties as a service (software as a service), including under those parties’ own names. By using the Demo the user acquires no rights to the Platform beyond clause 5.2.

5.4The Operator may use suggestions and comments communicated by the user free of charge and without restriction to improve the Platform.

5.5The list of champions of the Czech Republic and Czechoslovakia in DanceSport made available in the Demo (the “Champions Database”) is a database made by the Operator, who has made a substantial investment in obtaining, verifying and arranging its contents; it is protected by the sui generis right of the maker of a database under Section 88 et seq. of the Copyright Act. The user may only view the Champions Database within the Demo. Extraction or re-utilisation of the whole Champions Database or of a qualitatively or quantitatively substantial part of it, as well as repeated and systematic extraction of insubstantial parts of it, in particular by automated means, is prohibited without the Operator’s prior written consent. Records of the Champions Database may contain hidden marks by which the origin of a copy can be identified.

6. No warranty and limitation of liability

6.1The Demo is provided free of charge, “as is” and “as available”. The Operator gives no warranties, in particular as to uninterrupted availability, freedom from errors, fitness for a particular purpose, retention of entered data or accuracy of the sample data.

6.2To the extent permitted by law, the Operator is not liable for any harm arising in connection with the use of or inability to use the Demo, including loss of profit, loss of data or indirect damage.

6.3The limitation under clause 6.2 does not apply to harm caused intentionally or through gross negligence, nor to harm to a person’s natural rights (Section 2898 of the Civil Code). Consumer rights that cannot be limited by contract remain unaffected.

7. Personal data

7.1The processing of personal data in connection with the Demo is described in the Privacy policy.

8. Changes and final provisions

8.1The Operator may change these terms. The new version will be published on this page together with its effective date; the use of the Demo is governed by the version in effect at the time of use.

8.2These terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code. Disputes are decided by the competent courts of the Czech Republic.

8.3A consumer has the right to out-of-court resolution of a dispute. The competent body is the Czech Trade Inspection Authority (www.coi.cz), which also supervises compliance with consumer protection legislation. The Operator’s trade licence is subject to supervision by the competent trade licensing office.

8.4If any provision is invalid or ineffective, the other provisions remain unaffected. Please send questions and notices to kasalicky@proton.me.
